Overview.
Education Support Center (ESC), 9950 Campo Road, Suite 203B, Spring Valley, Ca. 91977 operates an online technology platform that allows individuals to play Bingo while supporting the organization and its causes. Education Support Center works for the benefit of the people in the eastern San Diego County to fight hunger and homelessness. ESC is a public charity exempt under Section 501(c)(3) of the U.S. Internal Revenue Code which operates a donor-advised fund to receive all donations made through the platform and make grants to charities selected by donors pursuant to the terms and conditions set forth herein. Education Support Center offers virtual online Bingo game on mobile app and website. (Downloadable in Google Store for android phones and App Store for apple phones). Access to mobile app game is offered by signing up or registering for the first time. For recurring game, players must purchase tokens to play and win real money.
In general terms, participation in the game on the mobile app is subject to these official rules. The game play, game timing, available prizing, odds of winning and all other specifics of participation in the game will be governed by the official rules for virtual online Bingo game (“Game Rules”).
Use of the mobile app (including participation in the game offered thereon) is subject to applicable laws and is void where prohibited by law.
Eligibility
Education Support Center virtual online Bingo game is open to those who are 13 years of age or older.
Education Support Center virtual online Bingo game is intended for anyone (13 years old and above) who downloads and registers to the mobile app and on the website: virtualonlinebingo.org.
Account Creation.
To participate in the Bingo game, a person must first sign up after downloading the mobile app on Google Store or App Store or on the website.
(a) Provide your first and last name, e-mail address, mobile number and a password.
(b) Carefully review these Platform Rules, the Terms & Conditions and the Privacy Policy and then check the box indicating that you agree to same.
* Standard message and data rates and/or wireless Internet access charges may apply. You may be charged by your wireless carrier in conjunction with doing so. Be sure to check your wireless carrier’s pricing plan before using a mobile device to access the app. Wireless Internet access may not be available in all areas and is not available on all mobile devices.
IN CREATING AN ACCOUNT, YOU UNDERSTAND AND AGREE TO THESE VIRTUAL ONLINE BINGO PLATFORM RULES (AS WELL AS THE TERMS & CONDITIONS AND THE PRIVACY POLICY) AND TO THE DECISIONS OF EDUCATION SUPPORT CENTER AS TO ALL ASPECTS OF USE OF THE MOBILE APP AND WEBSITE AND PARTICIPATION IN BINGO GAME, WHICH ARE FINAL AND BINDING IN ALL RESPECTS AND NOT SUBJECT TO APPEAL. IF YOU DO NOT AGREE TO THE PLATFORM RULES AND/OR THE DECISIONS OF EDUCATION SUPPORT CENTER RELATIVE TO USE OF THE GAME AND PARTICIPATION IN GAMES, DO NOT REGISTER, PLAY THE GAME OR OTHERWISE USE THE MOBILE APP.
IN REGISTERING AN ACCOUNT, YOU CONSENT TO EDUCATION SUPPORT CENTER IN COLLECTION, STORING, USAGE AND SHARING OF YOUR PERSONAL INFORMATION AS SET FORTH IN OUR PRIVACY POLICY. WITHOUT LIMITATION, YOU CONSENT TO EDUCATION SUPPORT CENTER CONTACTING YOU VIA E-MAIL AND/OR POSTAL MAIL (AS APPLICABLE) REGARDING YOUR USE OF THE MOBILE APP (INCLUDING YOUR PARTICIPATION IN THE GAME) AND THE WEBSITE.
In signing up, you represent and warrant that all information provided is truthful. Should Education Support Center determine that any information is false or fraudulent your account(s) will be cancelled and you may be prohibited from future use of the mobile app or on the website; and, in addition, Education Support Center reserves the right to pursue any and all available legal remedies against you so as to protect its rights.
It is the accountholder’s sole responsibility to periodically review his/her/their account information and update same as appropriate. Education Support Center recommends that you allow up to five (5) business days for changes in account information to be reflected on the mobile app. Education Support Center disclaims any liability arising from the accountholder’s failure to maintain the currency and accuracy of his/her/their account information. The preceding includes, by way of example only, the receipt of prize monies being delayed (or not received at all) due to inaccurate, incomplete or invalid contact information.
It is the accountholder’s sole responsibility to maintain the security of his/her/their password. Education Support Center recommends that you properly store your password so as to prevent disclosure, as your account will contain not only your personal information, but any prize monies won in the game. ESC disclaims any liability arising from the accountholder’s failure to safeguard his/her/their and any resultant harm caused by unauthorized access to his/her/their account. If you believe that your account has been compromised, it is your sole responsibility to immediately report same to Education Support Center using the functionality on the Website. While Education Support Center will endeavor to promptly deactivate your account, Education Support Center disclaims any liability in conjunction therewith.
Any dispute as to the ownership of a given account will be resolved by Education Support Center in its sole discretion. In making such determination, Education Support Center shall take into account (but will not necessarily be bound by) the identification of the individual who is the authorized account holder of the of the e-mail address provided at the time of account creation. “Authorized accountholder” is the natural person assigned to an e-mail address by an Internet access provider, on-line service provider, or other organization which is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
By using a payment method (e.g. – VISA, MasterCard, American Express, Discover credit or debit card or PayPal) to participate in the game offered on the mobile app and on the website, the Authorized accountholder hereby affirms that he/she is the lawful owner of the payment method account used to make any donation(s) on the app. It shall be a violation of these Platform Rules for any Authorized accountholder to submit payment using any payment method that is not owned by the Authorized accountholder.
Education Support Center reserves the right to temporarily suspend an account or prevent an accountholder from making any further withdrawal request(s) in the event a credit or debit card is declined by Education Support Center’s payment processor for any and all reasons. ESC may require the accountholder to provide proof of identity and ownership of any failed payment method, including requesting a valid, non-expired photo ID as well as proof of address in the form of current bank or credit card statement and/or a utility bill that matches the name and address on the photo ID and entered on the mobile app at the time of registration attempt.
ALL PURCHASES ARE FINAL AND NONREFUNDABLE AND THERE ARE NO REFUNDS OR CREDITS FOR UNUSED TOKEN.
Important Restrictions:
A given Submission Code and Redemption Code are to be used solely only once by the individual who received same directly from Education Support Center. ANY OTHER USE OF SUBMISSION CODES OR REDEMPTION CODES IS PROHIBITED, WITH SUCH SUBMISSION/REDEMPTION CODES NOT BEING ACCEPTED, AS WELL AS POSSIBLE ACCOUNT CANCELLATION, PROHIBITION OF FUTURE USE OF THE MOBILE APP AND THE WEBSITE AND EDUCATION SUPPORT CENTER RESERVES THE RIGHT TO PURSUE ANY AND ALL AVAILABLE LEGAL REMEDIES AGAINST SUCH PERSON SO AS TO PROTECT ITS RIGHTS.
Tokens
As fully set forth in the Terms & Conditions, tokens are to be used solely by the accountholder on the mobile app or website in full compliance with the Terms & Conditions, these Virtual Online Bingo Platform Rules and the applicable Game Rules. ANY OTHER USE OF TOKENS IS PROHIBITED, WITH SUCH TOKENS NOT BEING ACCEPTED AND MAY RESULT IN CANCELLATION OF ACCOUNT, PROHIBITION OF FUTURE USE OF THE MOBILE APP RESERVES THE RIGHT TO PURSUE ANY AND ALL AVAILABLE LEGAL REMEDIES AGAINST SUCH PERSON SO AS TO PROTECT ITS RIGHTS.
Without limiting the foregoing, tokens are not transferable and cannot be purchased, sold, traded or exchanged between accountholders.
If accountholder does not participate in at least one (1) game on the app within a given six (6) month period, all tokens in his/her/their account as of the conclusion of such six (6) month period (regardless of when and how obtained by accountholder) are void and expire with Education Support Center having no liability for same under any legal theory. EDUCATION SUPPORT CENTER MAY – BUT IS IN NO WAY OBLIGATED TO — PROVIDE A WARNING NOTICE PRIOR TO VOIDING/EXPIRATION OF TOKENS. IT IS THE ACCOUNTHOLDER’S SOLE RESPONSIBILITY TO KEEP TRACK OF HIS/HER/THEIR LAST DATE OF ACTIVITY ON THE WEBSITE SO THAT TOKENS DO NOT BECOME VOID AND EXPIRE.
At all times, Education Support Center shall own all rights to tokens; and, as such, Education Support Center grants to accountholder. For the avoidance of doubt, no property right in tokens is conferred by Education Support Center to the accountholder receiving said tokens under any legal theory.
Winner Determination.
Winners will be determined in the manner specified in the Game Rules. (As discussed in Rule 1 above).
IN ALL CASES, AWARD OF A PRIZE IS SUBJECT TO VERIFICATION BY EDUCATION SUPPORT CENTER.
Prize Award & Prize Restrictions
Prize monies will be deposited into the winner’s account following the conclusion of the game. Subject to specific minimum withdrawal amounts, a winner may withdraw prize monies at any time once prize monies have been reflected in his/her/their account.
To do so, follow the on-screen instructions on your “My Wallet” then “Withdraw” button page, providing the amount to be withdrawn as prize monies.
You must also agree to processing fees which may be imposed by Education Support Center on the withdrawal of prize monies as well as the required minimum withdrawal amounts, as follows:

For ACH and PayPal Withdrawals: a winner may only withdraw prize monies if equal to or greater than $1.00.
THE ABOVE-INDICATED RESTRICTIONS ON WITHDRAWALS – INCLUDING PROCESSING FEES AND PROCESSING TIMES — ARE SUBJECT TO CHANGE. AT THE TIME OF ANY AND ALL CHANGES, EDUCATION SUPPORT CENTER WILL UPDATE THESE PLATFORM RULES ACCORDINGLY. IT IS THE ACCOUNTHOLDER’S SOLE RESPONSIBILITY TO REVIEW THESE PLATFORM RULES PERIODICALLY TO DETERMINE THE CURRENT PROCESSING FEE AND MINIMUM WITHDRAWAL AMOUNTS OF PRIZE MONIES.
Education Support Center reserves the right, in its sole discretion, to condition the awarding/distribution of prize monies upon verification of the potential winner’s full compliance with the Virtual Online Bingo Platform Rules as well as the applicable Game Rules.
All taxes on prize monies are solely the winner’s responsibility.
If prize monies exceed $599.99 in a given calendar year, winner must complete and execute an IRS W9 Tax Form with their Social Security Number so that Education Support Center may issue the winner an IRS 1099 Tax Form and report the winner’s receipt of prize monies to the Internal Revenue Service in accordance with applicable law. Refusal to return the completed/executed IRS W9 Tax Form upon Education Support Center’s request may result in forfeiture of prize monies with such refusal resulting in cancellation of account and prohibition of future use of the mobile app.
Education Support Center strongly advises that prize winners consult with their accountant or other tax professional as to whether (and, if so, to what extent) prize monies may be tax-deductible.
EDUCATION SUPPORT CENTER MAKES NO REPRESENTATION, GUARANTEE OR WARRANTY OF ANY KIND THAT PRIZE MONIES ARE TAX-DEDUCTIBLE OR ELIGIBLE FOR OTHER FAVORABLE TAX TREATMENT.
All unspecified expenses in conjunction with prize claim (e.g., if payment via ACH is selected; fees imposed by PayPal if such payment method is selected), prize acceptance and use are the winner’s sole responsibility. Prizes are not transferable.
Releases.
You indemnify, release and agree to hold harmless Education Support Center, Sponsor’s Affiliates from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property arising out of or relating to your use of the mobile app and acceptance, possession, receipt or use/misuse of prize monies (as applicable).Force Majeure
If, for any reason, the game is not capable of running as planned by reason of infection by computer virus, worms, bugs, tampering, unauthorized intervention, fraud, technical failures, fire, flood, storm or other natural cataclysm, epidemic/pandemic, riot, strike, civil commotion, governmental regulation or any other causes beyond the control of Education Support Center which, in its sole opinion, corrupt or affect the administration, security, fairness, integrity or proper conduct of such promotional game, Education Support Center reserves the right at its sole discretion to cancel, terminate, modify or suspend such affected promotional game making prize(s) available for same in a manner which is fair, equitable and in accordance with the applicable Game Rules for such promotional game, as determined by Education Support Center in its sole discretion. Without in any way limiting the foregoing, should a promotional game be cancelled outright, the liability of Education Support Center shall be limited to return to participants in such affected game of the token used to participate in same. Notice of any such action by Education Support Center will be posted on the mobile app and on the website.
Additional Limitations of Liability.
Education Support Center is not responsible for:
(a) communications (whether sent to or sent by an individual) which are late, lost, garbled, incomplete, inaccessible/blocked, corrupted, jumbled, misdirected, delayed or damaged, regardless of cause, all of which are void;
(b) incomplete, incorrect or inaccurate information whether caused by app users, tampering, hacking or by any of the equipment or programming associated with or utilized on the mobile app including in any game offered thereon, regardless of cause;
(c) any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of any function or feature of the mobile app or communications (whether sent to or sent by an individual);
(d) any problems or technical malfunctions of any telephone network or lines, computer on-line-systems, servers or providers, computer equipment, software, programming or failure of communications (whether sent to or sent by an individual) on account of technical problems or traffic congestion on the Internet or at any mobile app (including but not limited to the mobile application) inability to access one or more bingo games offered on the mobile app during the corresponding time period due to any of the foregoing reasons;
(e) any injury or damage to entrant’s or to any person’s computer or mobile device (or any information/materials stored therein) related to or resulting from downloading materials from the mobile app or using the mobile app including participating in any promotional game offered thereon.
In the event of any inconsistency between these Virtual Online Bingo Platform Rules and the content of any materials advertising the mobile app or any Bingo game offered thereon, these Platform Rules shall prevail, govern and control in all respects.
The failure of Education Support Center to enforce any provision of these Virtual Online Bingo Platform Rules in a given instance shall not constitute the ongoing waiver of such provision.
The bingo game offered on the mobile app and website is in no way sponsored, endorsed or administered by, or associated with, Facebook.
Tampering
CAUTION: ANY ATTEMPT BY A PERSON TO DELIBERATELY DAMAGE THE MOBILE APP AND WEBSITE, UNDERMINE THE LEGITIMATE OPERATION OF THE APP (INCLUDING BUT NOT LIMITED TO ANY BINGO GAME OFFERED THEREON), USE A PROGRAM OR “BOT” TO PLAY MULTIPLE GAMES CONCURRENTLY OR TO AVOID ACTUALLY OPERATING THE GAME OR OTHERWISE ATTEMPT TO DEFRAUD EDUCATION SUPPORT CENTER IN CONJUNCTION WITH THE MOBILE APP (INCLUDING BUT NOT LIMITED TO ANY GAME OFFERED THEREON) WILL RESULT IN IMMEDIATE CANCELLATION OF ACCOUNT, PROHIBITION FROM FUTURE USE OF THE MOBILE APP AND, IN SUCH INSTANCE, EDUCATION SUPPORT CENTER RESERVES THE RIGHT TO PURSUE ALL AVAILABLE LEGAL REMEDIES AGAINST SUCH PERSON.
Disputes & Choice of Law
As fully set forth in the Terms & Conditions, participants understand and agree that:
(a) Any claims or disputes regarding the game, these Platform Rules or the Game Rules will be resolved pursuant to the internal, substantive law.
(b) ANY CLAIMS OR DISPUTES REGARDING THE GAME, THESE PLATFORM RULES OR THE GAME RULES FOR BINGO GAMES WILL BE RESOLVED BY BINDING ARBITRATION AND NOT IN A COURT OF LAW VIA TRIAL BY JURY.
